The National Defense Authorization Act of Fiscal Year 1997 (FY 97) allows for the 1033 Program to transfer excess Department of Defense property to Law Enforcement Agencies (LEAs) across the United States. This includes access to weapons that are loaned by the US Army TACOM LCMC through the 1033 Program to LEAs.

Additionally, weapons that have been previously issued, can be transferred at a 100% allocation rate. All future weapons request will be submitted through the FEPMIS weapons module for approval by the State Coordinator and LESO.
All transfers will be requested via e-mail. Contact your State Coordinator for proper format. All serial numbers will be loaded automatically into FEPMIS upon shipment from Anniston Depot. Agencies will be required to receipt for weapons in LESO FEPMIS with a photo of the weapon serial number.
LESO reminds LEAs that weapons obtained through the 1033 program are on loan from the DOD and remain the property of the DOD.
Modifications can not be permanent. LEAs are required to retain all original parts and all weapons must be restored to the original configuration upon return to U.S. Government control.
Trading, bartering or selling of the weapons is strictly prohibited by the Memorandums of Agreement signed between your State and LESO. Any incidents of trading, bartering, selling, damage to, or theft of 1033 Program weapons will be forwarded to the DLA Office of the Inspector General (OIG).
